Yet business responsibilities for human rights are mainly voluntary and likely best termed ‘soft law’. Recently, however, several states have begun negotiations for an international binding treaty in this area suggesting a need to turn to ‘hard law’ to increase the efficacy of business and human rights (BHR) initiatives. The term soft law is used to denote agreements, principles and declarations that are not legally binding. Soft law instruments are predominantly found in the international sphere. UN General Assembly resolutions are an example of soft law. Hard law refers generally to legal obligations that are binding on the parties involved and which can be legally enforced before a court. The Aim of the Human Rights and Piracy programme is to research and develop world-class soft law guidance in response to the global piracy issue with a specific focus on the application of human rights at sea.
